Article 1: Scope and acceptance
These terms and conditions (hereinafter the “Terms”) govern the use of the withholdingtax.ch tax estimation service, intended for B permit holders in Switzerland.
Use of the service implies full and unreserved acceptance of these Terms. If you do not accept them, please do not use the service.
Altinova Sàrl reserves the right to amend these Terms at any time. Amendments take effect as soon as they are published on the site.
The tax disclaimer, accessible from every page of the site, forms an integral part of these terms. For the paid service described in article 10, express acceptance of it is required before any payment.

Article 2: Description of the service
withholdingtax.ch is a tax estimation service that allows B permit holders to:
- Compare their current withholding tax with subsequent ordinary taxation (TOU)
- Estimate the potential savings from switching to ordinary taxation
- Understand the tax implications in 16 Swiss cantons
- Obtain an estimate based on 2025–2026 tax data
- Obtain a pre-filled official request form for subsequent ordinary taxation
The service performs all calculations client-side (in your browser) to keep your tax data confidential.
The estimate is free and remains so. Only the preparation of the official form is charged for, under the conditions of article 10.

Article 3: Use of the calculator
The user undertakes to:
- Provide accurate and complete information
- Use the service for personal and lawful purposes only
- Make no attempt to circumvent security measures
- Respect intellectual property rights

Article 4: Accuracy and limits
Documented technical limits
- Low-income deductions (below CHF 50k) may differ for VD, FR, VS, NE, AG, LU
- BL church tax: the Protestant/Christian Catholic scale uses an approximation
- Married scenarios: systematic difference of CHF 8–15 caused by rounding
- Lucerne: the Entlastungsabzug (relief for modest incomes) is not implemented
Calculations are based on official data from the Federal Tax Administration (FTA) and the cantonal tax offices. The results provided are nonetheless estimates and may differ from the actual amounts.
The user acknowledges that the service has documented technical limitations and accepts that the results may differ from their actual tax position.

Article 5: No professional tax advice

- The estimates provided do NOT replace the opinion of a licensed tax adviser or accountant.
- Altinova Sàrl is NOT a licensed tax adviser and provides NO personalised advice.
You MUST consult a qualified professional before any tax decision.
The service provides estimates for information purposes only. Those estimates in no way constitute professional tax, legal or financial advice.
Altinova Sàrl is not authorised to provide tax advice and declines all liability for decisions taken on the basis of the estimates provided.

Article 6: User responsibility
The user is solely responsible for:
- The accuracy of the data entered
- Verifying the results with the tax office
- Understanding the implications of switching to ordinary taxation
- Complying with their statutory tax obligations
- Consulting a qualified professional before any decision

Article 7: Limitation of liability
Within the limits permitted by Swiss law, Altinova Sàrl excludes all liability for:
- Indirect or consequential damages
- Loss of income or loss of profit
- Tax penalties arising from use of the service
- Differences between the estimate provided and the final assessment issued by the tax office
Non-exclusions (Swiss law)
- Gross negligence or intent
- Data protection breaches
- Personal injury
The liability of Altinova Sàrl is limited in accordance with articles 97 to 109 of the Swiss Code of Obligations.
For the paid service, Altinova Sàrl's liability is in all cases limited to the amount actually paid for the service concerned, save in cases of gross negligence or intent.

Article 8: Data protection
The processing of personal data is governed by our privacy policy, which complies with the Federal Act on Data Protection (revFADP) of September 2023.

Privacy by design
All tax calculations are performed in your browser. No tax data is transmitted to our servers.

Article 9: Intellectual property
The calculation algorithms, the source code and all content on the site are the exclusive property of Altinova Sàrl and are protected by Swiss intellectual property law.
The tax data used comes from public sources (Federal Tax Administration and cantonal tax offices).
The user retains all rights over the data they enter into the calculator.

Article 10: Paid form preparation service
In addition to the free estimate, Altinova Sàrl offers the preparation of an official request form for subsequent ordinary taxation (TOU), pre-filled from the data you enter.
- Price
- CHF 20, VAT included. One-off payment, no subscription and no recurring charges.
- Free cantons
- The service is charged for the canton of Vaud only. In the fifteen other cantons covered, the form is provided free of charge.
- Delivery
- The form is made available for download immediately after payment is confirmed, and a recovery link is sent to the email address provided.
- Nature of the service
- The service consists solely of transferring your data into the official cantonal form and formatting it. Altinova Sàrl does not file the request with the tax office, does not represent you before it, and does not express any view on whether your request is advisable. Sending the signed form to the canton is your responsibility.
- Scope of the undertaking
- Altinova Sàrl undertakes a best-efforts obligation as to the accuracy with which the data you entered is transferred. It guarantees neither the acceptance of your request by the tax office nor the amount of any refund.
- Refund
- If the delivered form is unusable owing to a technical failure attributable to us, the price paid is refunded in full, upon request sent to our contact address within thirty days of purchase.
- Right of withdrawal
- The form is digital content delivered immediately. Once the download has been made available, the service has been performed and can no longer be cancelled. Swiss law provides no general right of revocation for contracts concluded online (art. 40a ff. CO).
- Filing deadline
- No order is accepted once the statutory deadline of 31 March has passed for the tax year concerned: the canton would reject the request.

Article 11: Amendments to the Terms
Altinova Sàrl reserves the right to amend these Terms at any time.
Amendments will be notified on the site with reasonable notice.
Continued use of the service after an amendment constitutes acceptance of the new Terms.

Article 12: Governing law and jurisdiction
These Terms are governed exclusively by Swiss law.
In the event of a dispute, the parties will endeavour to reach an amicable settlement.
Failing that, the courts of the canton of Valais have exclusive jurisdiction.

Article 13: Severability
Should any provision of these Terms be held void or unenforceable, the remaining provisions shall remain in full force.
